主旨： 有關教師多胞胎之哺乳時間計算疑義一案。
說明：
一、 依據教育部103年11月5日臺教人(三)字第1030156410號函辦理。
二、 教育部函釋：銓敘部103年10月22日函略以，勞動部103年10月3日勞動條4字第1030132064號函說明二「．．．勞雇雙方可在總時數不超過1小時時間內，視泌乳情形及受哺乳子女需求，協商調配增加哺乳次數；或可依其親自哺乳子女數增加哺乳時間，增加之哺乳時間是否視為工作時間由勞雇雙方協商議定之」一節，以性別工作平等法第18條已明定受僱者親自哺乳未滿1歲子女者，除規定之休息時間外，雇主應每日另給哺乳時間2次，每次以30分鐘，且考量政府各機關公務人員工作條件之一致性及兼顧機關業務之遂行，故公務人員撫育未滿1歲之多胞胎子女之哺乳時間每日仍以1小時為限。本案考量教師類此情形與公務人員並無不同，爰教師亦應比照辦理。
