「高級中等教育法（下稱本法）」第34條規定：「國民中學畢業生或具同等學力者，具有高級中等學校入學資格；同等學力之認定標準，由中央主管機關定之。」，又依「入學高級中等學校同等學力認定標準」第2條規定：「本法第34條所定同等學力，其認定基準如下：
一、曾在公、私立國民中學或相當於國民中學教育階段之學校修習三年級課程，持有修業證明書。
二、依國民教育法規定，經主管機關許可參加相當於國民中學階段之非學校型態實驗教育二年以上，有證明文件。
三、曾在公、私立國民中學附設補習學校或已立案之私立中級補習學校修業期滿，取得結業證明書或修業證明書。
四、經國民中學畢業程度自學進修學力鑑定考試及格，取得學力鑑定通過證書。
五、取得丙級技術士證或相當於丙級以上技術士證之資格。」。
