| 主旨： | 有關行政院人事行政總處函以，退休人員犯貪污治罪條例，經判刑確定而入監服刑，其三節慰問金應停止發給一案，請查照。 |

| 一、 | 依行政院人事行政總處105年6月20日總處給字第1050045130號書函副本辦理。 |
| 二、 | 查原行政院人事行政局（以下簡稱原人事局）100年6月20日局給字第1000036800號函規定略以，退休公務人員三節慰問金之發給，旨在表達慰問退休人員之意，為期與退休人員其他權益衡平，歷來均與其是否有停發月退休金、優惠存款利息之情形作一致性處理。爰合於照護規定之退休公務人員，其退休再任如有依公務人員退休法第23條第1項及第32條第6項規定須停止其領受月退休金及辦理優惠存款權利者，其三節慰問金應同時停止發給，至其再任原因消滅後恢復。 |
| 三、 | 復查105年5月13日修正施行之公務人員退休法第23條增訂第1項第1款及第3款明定擇（兼）領月退休金人員如有犯貪污治罪條例或刑法瀆職罪章之罪而入監服刑期間，或因案被通緝期間，應停止領受月退休金之權利，至原因消滅時恢復。又同法第32條第6項規定略以，支領一次退休金或養老給付並依規定辦理優惠存款人員，如有第23條及第24條規定應停止或喪失領受月退休金情事者，其優惠存款應同時停止辦理。爰旨述人員依公務人員退休法第23條及第32條規定，應停止領受月退休金及辦理優惠存款權利，其三節慰問金自應依前開原人事局100年6月20日函規定意旨同時停止發給，至原因消滅時恢復。 |
