主旨：關於公務人員請假規則（以下簡稱請假規則）所定生理假
之日數核計方式，請查照轉知。
說明：
一、查請假規則第3條第1項規定：「公務人員之請假，依下列
規定：一、因事得請事假，每年准給7日……超過規定日數
之事假，應按日扣除俸（薪）給。二、因疾病或安胎必須
治療或休養者，得請病假，每年准給28日。女性公務人員
因生理日致工作有困難者，每月得請生理假1日，全年請假
日數未逾3日，不併入病假計算，其餘日數併入病假計算。
其超過者，以事假抵銷……。」綜上，女性公務人員因生
理日致工作有困難者，每月得請生理假1日，全年至多得請
生理假12日，且全年請生理假日數未逾3日，不併入病假計
算，其餘日數併入病假計算；病假及併入病假計算之生理
假合計超過病假准給日數（28日）部分，以事假抵銷，已
無事假抵銷者，應按日扣除俸（薪）給。
二、茲就前開有關生理假日數核計規定舉例說明如下：假設某
女性公務人員全年請生理假12日、病假20日及事假7日，其中生理假未逾3日部分不併入病假計算，餘9日生理假，加
計所請病假20日，合計29日，逾病假准給日數部分（1日）
以事假抵銷，惟該員已請畢事假准給之7日，爰上開逾病假
准給日數之1日，應按日扣除俸（薪）給。
三、本部歷次函釋與本解釋未合部分，自即日起停止適用。
